Artist Agreement Policy

1. Agreement Overview

This Artist Agreement ("Agreement") is entered into between Born To Banger, operated by Dev Group ("Company," "we," "us"), and the artist ("Artist," "you") who registers to provide entertainment activities through our platform. This agreement is subject to our general Terms & Conditions and Privacy Policy.

2. Artist Registration

2.1 Eligibility

To register as an artist, you must:

• Be at least 18 years of age or have parental consent
• Provide accurate and complete information
• Possess the necessary skills and equipment for your performance category
• Have the legal right to work in India

2.2 Registration Process

• Complete the online registration form
• Submit portfolio materials (photos, videos, reels)
• Undergo verification and approval process
• Sign this agreement electronically or in writing

3. Booking and Performance Terms

3.1 Booking Acceptance

Artists agree to accept bookings in good faith and maintain availability as indicated in their profile. Artists must confirm or decline bookings within 24 hours of receiving a booking request.

3.2 Performance Standards

• Arrive at the venue at least 30 minutes before the scheduled performance
• Bring all necessary equipment unless otherwise agreed
• Deliver high-quality, professional performance
• Maintain appropriate conduct and professionalism
• Adhere to the agreed performance duration

4. Payment Terms

4.1 Compensation

• Artists will be paid based on the agreed rate for each booking
• Payment includes performance fees as discussed during booking
• Born To Banger retains an activity commission (percentage to be specified per booking)
• All payments are subject to applicable taxes

4.2 Payment Schedule

• Payments will be processed within 7-10 business days after event completion
• Artists must provide valid bank account details and tax information
• Payments will be made via bank transfer or UPI
• Artists are responsible for any bank transfer fees on their end

5. Cancellation by Artist

5.1 Advance Notice

• 7+ days notice: No penalty
• 3-6 days notice: Warning; repeated instances may affect future bookings
• Less than 3 days notice: Possible account suspension
• Same-day cancellation: Account suspension and potential legal action

5.2 Emergency Situations

Medical emergencies and force majeure events will be considered on a case-by-case basis. Documentation may be required.

6. Artist Responsibilities

• Maintain updated profile information and availability
• Respond promptly to booking requests and communications
• Maintain professional behavior at all times
• Respect venue rules and client requirements
• Obtain necessary licenses, permits, and insurance
• Pay applicable taxes on earned income
• Not engage in direct bookings with clients contacted through BTB

7. Company Responsibilities

• Provide booking opportunities across Delhi NCR
• Handle client communications and payments
• Provide marketing and promotional support
• Ensure timely payment for completed bookings
• Address disputes fairly and transparently
• Protect artist information in accordance with our Privacy Policy

8. Intellectual Property

8.1 Artist Content

Artists grant Born To Banger a non-exclusive, royalty-free license to use submitted photos, videos, and portfolio materials for marketing and promotional purposes. Your data will be handled according to our Privacy Policy.

8.2 Performance Rights

Artists are responsible for obtaining necessary music licenses and rights for their performances. Artists warrant they have the right to perform all content in their act.

9. Liability and Insurance

• Artists are independent contractors, not employees of Born To Banger
• Artists are responsible for their own equipment and belongings
• Artists should maintain appropriate liability insurance
• Born To Banger is not liable for injuries or damages during performances
• Artists indemnify Born To Banger against claims arising from their performances

10. Non-Compete and Exclusivity

No Exclusivity: Artists are free to work with other agencies and platforms.

Direct Client Booking Restriction: Artists agree not to accept direct bookings from clients contacted through Born To Banger for a period of 12 months from first contact, without involving the company.

11. Termination

11.1 By Artist

Artists may terminate this agreement at any time with 30 days written notice. All pending bookings must be fulfilled or properly canceled.

11.2 By Company

Born To Banger may terminate this agreement immediately in cases of:

• Breach of agreement terms
• Unprofessional conduct
• Multiple cancellations or no-shows
• Poor performance reviews
• Fraudulent activity

12. Dispute Resolution

Any disputes arising from this agreement shall be resolved through:

• Initial discussion and negotiation between parties
• Mediation if direct resolution fails
• Arbitration in Delhi, India if mediation fails
• Legal proceedings in Delhi courts as a last resort

13. Amendments

Born To Banger reserves the right to modify this agreement with 30 days notice to registered artists. Continued use of the platform after changes constitutes acceptance.
